Paz, guerra e interven??o no pensamento de Kant : possibilidades e limites do uso da for?a no direito internacional

Resumo: The thesis examines Kant?s thought on war, analyzing its potential admissibility, its boundaries and its function in Kant?s juridical and political theory. The text analyzes the texts of ?Toward Perpetual Peace? and ?Doctrine of Right? to better comprehend Kant?s thought on public law, international law and cosmopolitan law. There is an explanation on the essential parts of public law: the idea of a juridical state, the notion of original contract and the idea of republican constitution. The text also analyzes the divergences between the texts of ?Toward Perpetual Peace? and ?Doctrine of Right?, with a proposal of an explanation based in the view of selected authors. According to the thesis, Kant disapproves morally the war, but admits its existence in the state of nature between the nations, under a provisional international law, in specific cases and with limited means. Kant admits self-defense to protect the safety of the State, also in a precautionary basis. In the hypothesis of existence of an unjust enemy, the function of war in Kant?s thought becomes clearer. There is a permission to enforce the removal of the unjust enemy from the state of nature between States, and to enforce the establishment of a new constitution, increasing the number of republics eligible to enter in a juridical state between nations. In this view, the war connects with the essential parts of public law according to Kant?s thought, and must serve to promote the juridical state and the republican constitution. Although morally negative, the war can serve, as a last resource, as a means to achieve perpetual peace.

Analisam-se conjuntamente os textos de ?? Paz Perp?tua? e da ?Doutrina do Direito? para a elucida??o dos termos da posi??o de Kant em rela??o ao direito p?blico e, mais especificamente, do direito das gentes e do direito cosmopolita. Para tanto, h? uma exposi??o dos componentes essenciais do direito p?blico, a saber: a ideia de estado jur?dico, a no??o de contrato origin?rio e a ideia de constitui??o republicana. As diferen?as entre os textos de ?? Paz Perp?tua? e da ?Doutrina do Direito? s?o tamb?m objeto de questionamento, aventando-se uma explica??o a partir da leitura de int?rpretes selecionados. De acordo com a leitura proposta nesta tese, Kant reprova moralmente a guerra, mas admite a sua exist?ncia no estado de natureza entre as na??es, regido por um direito das gentes meramente provis?rio, circunscrevendo a admissibilidade do conflito armado a algumas hip?teses espec?ficas e com meios limitados. Kant admite a autodefesa, inclusive em car?ter preventivo, para a finalidade de conserva??o da integridade do Estado atacado. Na hip?tese de exist?ncia de um inimigo injusto, fica clara a fun??o da guerra no pensamento de Kant, com a permiss?o de promover a remo??o for?ada do inimigo injusto do estado de natureza interestatal, de forma a promover a ado??o de uma constitui??o e aumentar, de forma coercitiva, o n?mero de rep?blicas aptas a instaurar um estado jur?dico entre as na??es. Nessa linha, a eventual admissibilidade da guerra guarda conex?o com os elementos fundamentais do sistema de direito p?blico segundo Kant, devendo servir ? promo??o de um estado jur?dico e de uma constitui??o republicana.
