Resumo: The Brazilian Criminal Justice System is often classified as “adversarial” instead as “inquisitorial”, dichotomy that has been used by the Supreme Court itself in a great number of cases. Nonetheless, there is little consensus about how police, prosecutors and courts interact one with another in the midst of this “adversarial” system and, specially, during criminal investigation. This work argues that the dichotomy “adversarial x inquisitorial” is not sufficient, as a theoretical tool, to explain the dynamic structure of the Brazilian Criminal Justice System. It stresses the relevance of the historical perspective of Brazilian criminal investigation and points out how the Brazilian Criminal Justice was reformed during the nineteenth century, time when relationship between “police and courts” was already discussed in Congress. It stresses the impact of the Brazilian Constitution of 1988 on criminal investigation and in the activities of police, prosecutors and courts.

O trabalho também identifica que, apesar deste consenso teórico, há uma intensa controvérsia, na própria jurisprudência da Corte, a respeito dos espaços de atuação das instituições cujas atividades repercutem no Sistema de Justiça. A dificuldade de delimitação a respeito das interações recíprocas havidas entre Polícia, Ministério Público e Poder Judiciário é especialmente perceptível ao se analisar a atividade de investigação criminal, em relação à qual há importantes dissensos na jurisprudência do Supremo Tribunal Federal. A partir desta constatação, o trabalho questiona a real capacidade da dicotomia “acusatório x inquisitivo”, enquanto instrumento classificatório, para a compreensão do aspecto dinâmico da Justiça Criminal brasileira. Com fundamento na doutrina, o trabalho busca compreender as limitações teóricas que levam a dicotomia a ser uma ferramenta útil, porém insuficiente, para o atingimento deste objetivo. O trabalho defende que a delimitação dos espaços de atuação institucionais, no âmbito do Sistema de Justiça Criminal e, especialmente, no da investigação criminal, pode ser auxiliado pela compreensão histórica deste fenômeno. A partir daí o trabalho resgata os contextos histórico e político das reformas judiciárias ocorridas, no Brasil, durante o século XIX, momentos em que as interações recíprocas entre “polícia e justiça” foram objeto de intensos debates parlamentares. Em seguida, o trabalho passa à análise dogmática das normas que outorgam atribuições às instituições que concorrem para a atividade de investigação criminal.
