Criminalização da pobreza e reordenamento institucional: o acolhimento de crianças e adolescentes na conjuntura de desmonte das políticas sociais

The present study aims to discuss institutional reception as a "protective measure", part of the child and adolescent care policy, with its particularities in the municipality of Campina Grande - PB. In order to do so, we sought to discuss the course of public policies in the field of comprehensive protection for the child and youth population, and in particular, the social assistance policy, permeated by socio-historical transformations and their economic, political and social determinants, focusing on analyzes the contemporary context of crisis, demarcated by neoliberal policies and the criminalization of poverty in dealing with the social issue. Thus, we aim to reveal the level of the institutional reorganization process provided for in Law 12.010/09 for permanent shelter institutions in the city of Campina Grande. The theoretical-methodological course of this research was based on dialectical historical materialism, using bibliographic, documentary and empirical research, through the application of questionnaires and recorded and semi-structured interviews to determine the current care model, the logistics of the shelters of the municipality, the process of strengthening the bond of biological families and how the network structurally assists the family involved in the reception process. Our investigation empirically confirmed that the contradictions of capitalist society and the ineffectiveness of public policies to protect children and adolescents lead to a scenario of social lack of protection and consequently to the processes of institutionalization of children and adolescents. that the model of institutionalization of children and adolescents expresses a systemic denial of basic rights, and it is still necessary for the State, through “protective measures”, to judicialize and hold the family accountable for its economic vulnerability, implied by the bias of criminalization of poverty. In the reality studied, it was found that, even after 13 years in which a new paradigm of care for children and adolescents in institutional care was proposed, the back-up services and programs are still in a state of implementation to minimize the quantitative and rethink the forms of care, namely the Welcoming Family Service (still to be implemented) and the Guardian Family Program (this one is still experimental). As much as the legislation brings all the fundamental rights to the lives of children and adolescents, such as the right to family and community life, in practice this has not been applied, since the length of stay of children in shelter units still significantly exceeds what is provided for by law, resulting in harmful and irreparable damage arising from this institutionalizing model that deprives children and adolescents of their family and community life. Finally, it is concluded that, despite the ECA advocating that children can never be removed from their families for material reasons, this does not materialize in the reality studied, since the predominant model has been to criminalize poverty, for through the production of laws and legal reinforcement by the State that should protect children's rights.
