This work aimed to analyze the family conception (s) elaborated by PNAS in 2004, considering the perspectives adopted regarding gender issues. It was sought to understand the discourse of the modern family as a plural, dynamic and contradictory unit, built by the historical, economic and cultural movement, and as an expression of the diversity and complexity of the broad ways of living with the family. This dynamic produces changes in the main determinants that construct the conception of family: conjugality and sexuality; consanguinity and affiliation; cohabitation; affectivity; solidarity. The gender approach and its incorporation by the Social Assistance policy were discussed. It also analyzed the sociohistorical construction of this public policy, highlighting its main legal frameworks, post Federal Constitution of 1988. Finally, an interpretive reading was made, in the light of gender studies and relative studies of the social service itself regarding discourse PNAS official, trying to understand how the family appears as discursive elements of this Policy. Social assistance has materialized in a double effect: on the one hand, the protection of the family through the supply of basic necessities, on the other hand, giving it autonomy so that it can supply its needs. Some post-88 legal developments in the field of Women's Rights and Family Law stand out. In addition to PNAS / 2004, documents such as the Organic Law on Social Assistance were consulted; Brazilian constitutions; Maria da Penha Law; Statute of the Child and Adolescent and other current legislation pertinent to the subject of this research. The analysis of these documents allowed to identify in PNAS discourse: ambiguities in the concepts of family; centrality in the female gender; ruptures and political fragility that has made it difficult to materialize social assistance.
