Resumo: This paper aims, through psychoanalysis, using as theoretical frameworks Sigmund Freud and Jacques Lacan, discuss philosophical categories that support the law, as subject, Reason and Truth. Thus aims to demonstrate how the analytic discourse and the subject of psychoanalysis form the very reverse of speech and subject of philosophy, and therefore the law. In this way, it aims to question the law as discourse and its role in our times, especially before their decision by the scientific rationality of neoliberal capitalist efficiency. It is intended, in the end, to show that no one should deems the judiciary the task of operating as a substitute for a supposed deficit paternal function, and should not support a mass production system of laws, increasingly severe. The law should be seen as a current symptom and seek new subjectivities to support references that escape the logic masking the lack and think about the law as marked by a new principle and by the impossibility.

Assim, tem por objetivo demonstrar como o discurso analítico e o sujeito da psicanálise constituem o próprio avesso do discurso e sujeito da Filosofia e, logo, do Direito. Desta forma, tem por objetivo problematizar o Direito como discurso e seu papel hodiernamente, mormente diante de sua tomada pela racionalidade capitalista neoliberal cientifica de matriz eficientista. Pretende-se, ao final, demonstrar que não se deve reputar ao Judiciário a tarefa de operar como substituto de uma suposta função paterna deficitária, bem como não se deve suportar um sistema de produção em massa de leis, cada vez mais severas.
