The constitutional right to housing is a fundamental social human right; it is part of a decent living standard which is an essential condition to dwell in a city, here understood as a meeting place of citizenship and democracy. If disrespected, violation of the national socioeconomic order is expected. Public policies aimed at guaranteeing the effectiveness of this right find their fundaments in both international and national laws. In Brazil, the right to housing is especially granted in the Federal Constitution of 1988 and in the City Statute; both of them approached urban policy and reinforced its disciplinary base, whose example is the Law No. 11,977/2009, which provides for the regularization and the legitimization of possession. This study aims at analyzing the right to housing through the process of land regularization and the importance of possession legitimization as essential instruments to assure the integration of that right to cities. In addition, it aims at contextualizing the development of Brazilian urban policy, the right to housing and Land Regularization in an interdisciplinary perspective, and at identifying if the legitimization of possession has been used as an mechanism to regularize land possession of social interest. It also aims at observing the feasibility of its application with the enactment of Law No. 11,997/2009, regarding the realization of housing rights in urban settlements in the City of João Pessoa, State of Paraíba. The legal and social relevance of this work is due, among other things, to the fact that the Land Regularization constitute an instrument of great interest to those who seek to understand the urban dynamics and the housing problem; it is a way to understand how the legalization of soil can become a public policy of socio-integration of people in social disadvantage. Methodologically, the study was carried out through an analytical descriptive exploratory and historical procedure, that involved theoretical and documentary research.
