The dissertation reviews corruption as a phenomenon capable of growing deep roots and bringing ruinous consequences to the Brazilian financial sector, focusing on the national insurance sector. From the confirmation of the existence of an anti-corruption principle applicable to all business activities and of a Brazilian anti-corruption legal framework applicable to the insurance sector, recognized as from the publication of the Anti-Corruption Law (Law No. 12.846/2013), which placed the fight against corruption at the centre of the legal subsystem of Corporate Law, the role of the Superintendence of Private Insurance (SUSEP) in the fight against corruption and anti-corruption in the players part of the insurance ecosystem is analysed, in particular, in insurance companies, insurance brokers and reinsurers. It demonstrates the consequences of corruption in this insurance ecosystem, both from the point of view of insurance regulation and the insurance products sold in the country, particularly performance bonds and directors and officers’ civil liability insurance (D&O). The work aims to shed light on a subject that is still taboo in the insurance sector, inviting not only law enforcers but all agents part of the insurance ecosystem to reflect on corruption.
