The new information and communications technologies caused an explosion of narratives about the world. Since the popularization of the Internet in the mid-90s, and the cheapening of means of the cultural production, everyone, or at least almost everyone, can express their creativity and share their ideas. Not only can the artist the writer, musician, photographer, filmmaker, etc. produce meaning on the real. We are all fiction creators. We are all authors. The network has become the place to build the culture and to share memory. The digital casts a new social order based on network communication, collaborative work and distributed creativity. But many of the new narratives are constructed from pre-existing content, which are still under the protection of copyright law. In this sense, this thesis propounds a new way of thinking about the conflict between public and private interests in the author's rights field. Cybernetics, the science of communication and control, will serve as reflection mode about the relevance of the protection of literary and artistic works and the possible adaptation of copyright law to the digital context
