The work is about the compatibility of the conditions of eligibility and grounds for ineligibility with the principle of presumption of innocence, in the light of the constitutional principles of morality, probity and the superiority of public interest. It studies the Democracy and its essential foundations. The normative force of the Constitution, considering its importance in understanding the logical order of the system. It examines the fact of being required for anyone wishing to take a public duty or position the confirmation of moral suitability; who has spotless reputation, therefore, if that requirement stems from an objective condition, which is: the performance of activities of public interest, of which availability is far from the discretion of the administrator, can be, rightly, relieved of politicians. It is highlighted the superiority of the constitutional principles, which should be given the interpretation that best suits their purposes. It agrees with the proposition that in the collision between two principles should prevail the size of weight, and not the size of validity, proper of rules. A reflection is made about if the relevance of the exercise of citizenship as well as of the mechanisms of protection which are available by the legal system so that the democratic values of freedom and equality, based on respect for the human dignity are being taken into consideration to, in fact, give effectiveness to the constitutional rules.
