Resumo: The research investigates the way the gaps in the laws about rights of children influences the juvenile justice in Brazil, aiming to present an Restorative Justice based solution to the gap generated problems. The way on that juvenile offenders and juvenile justice workers comprehends the incarceration and no incarceration sanctions will be analized, looking to understand how this co mprehension is conditioned by the gaps. This research will then investigate the Restorative Justice model in development in Brazil on a bibliographical and law basis aiming to achieve a way to bridge the gap that is in order with the Holistic Protection Doctrine.

This research will then investigate the Restorative Justice model in development in Brazil on a bibliographical and law basis aiming to achieve a way to bridge the gap that is in order with the Holistic Protection Doctrine.A pesquisa busca investigar de que forma as lacunas das leis 8.069 de 1990 (Estatuto da Criança e do Adolescente) e do SINASE (12.594 de 2012) influenciam, negativamente, a implementação do Sistema Socioeducativo no Brasil, com escopo de propor uma forma de superação a partir do conceito de Enfoque Restaurativo. Para tanto, será investigado de que forma socioeducandos e profissionais dos programas de execução e do Sistema de Justiça percebem e interpretam as medidas privativas e não privativas de liberdade e de que forma tais interpretações estão condicionadas pelas lacunas identificadas, a partir da análise de pesquisas acadêmicas sobre o tema.
