Various human activities contribute to the scarcity of natural resources. The main one is the industrial activity and its products. In this context , it is noteworthy the construction , responsible for the high demand of non-renewable resources at the beginning of the production chain, the processes which depend on high energy consumption and high waste generation. To reconcile the potentially polluting activities to sustainable development , the National Environmental Policy Act created the environmental licensing as a tool to be used in order to minimize negative environmental impacts. Considering that Brazil was the country characterized by bureaucratic processes, the aim of this paper is to analyze the legal protection of the environment in the context of sustainable development, with emphasis on the role of the environmental license for the construction of condominiums and subdivisions in the city of Mossley and how effective the instrument responsible for environmental preservation. To consolidate research carried out a descriptive analysis of the responses obtained from the semi-structured questionnaires answered by the Director of Environmental Control of the Secretariat of the Environmental Management System (EMS ) in the city of Natal, three officials said Undersecretary responsible for overseeing projects that are in licensing and the managers of the selected contractors process. At the end of the survey it was found that the SGA has a body of compromised servers to protecting the environment and performs a well- coordinated work to achieve sustainable development in construction. It was also an absence of servers to carry out the inspection activities of the environmental licensing. Regarding companies that operate in the construction business, they were emphatic in stating the importance of environmental permits for the preservation of the environment, but that does not justify performing the procedure without clamor arising from excess requested documents , increasing the cost of work and delaying the granting of licenses. Given what was searched, it was found that environmental licenses in construction reduce negative environmental impacts.
