O que diz o judiciário? Externalidades negativas decorrentes do uso de agrotóxicos e a garantia de direitos humanos

The purpose of this dissertation is to investigate if the brazilian Judiciary plays its role in guaranteeing human rights to adequate food and to the ecologically balanced environment through the internalisation of negative externalities resulting from the use of pesticides. For this, the first chapter sought to understand what human rights are, showing this concept and foundations based on the traditional theory and then presenting the vision of the critical theory of human rights. From that point on, it has been shown how the recognition was achieved and how has been happening the redetermination of the human right to adequate food and to the ecologically balanced environment. Next, the role of the Judiciary and its contribution to the effectiveness of human rights were discussed, analyzing some aspects of the Brazilian Judiciary's performance and characteristics. In the second chapter, it was demonstrated how the use of pesticides in agricultural production began in Brazil, trying to show how the Brazilian State, especially the governments of the military regime, played a fundamental role in the adoption of the precepts of the green revolution and the advancement of agribusiness in the country. From that point on, the concept of negative externalities was discussed, exposing how this phenomenon happens through the use of pesticides in agriculture, and demonstrating that it violates human rights to adequate food and to the ecologically balanced environment. Also, some forms of internalisation of negative externalities were pointed out, showing the idea of the contribution of the Judiciary in this process. Finally, in the third chapter, we analyzed the Judiciary's performance through the investigation of judgments of the Federal Supreme Court and Superior Court of Justice, seeking to identify the position of these Courts regarding negative externalities, the fight against the use of pesticides and the guarantee of human rights.
