Resumo: Deaf people, who use sign languages for communication and social interaction, building their culture and community based on this linguistic particularity, have historically been excluded from society due to prejudice and discrimination. With the advent of important legal instruments, such as the 1988 Constitution of the Federative Republic of Brazil (CRFB), the Convention on the Rights of Persons with Disabilities (CRPD), the Brazilian Inclusion Law (LBI), and Law No. 10,436/2002, which officially recognized the Brazilian Sign Language (Libras), these individuals have gained special protection within the national legal framework. Among the essential mechanisms for the social inclusion of Deaf people, access to justice stands out, as it is the duty of public authorities to ensure it under equal conditions in relation to others, including the provision of adaptations and assistive technology resources whenever necessary. In this context, the present research aimed to analyze the performance of the state judiciary concerning Deaf people, seeking to assess the measures implemented to ensure their effective access to justice. The central research question was to evaluate to what extent the organizational policies adopted by the Maranhão State Court of Justice (TJMA) since the enactment of the LBI have been sufficient to promote inclusion and ensure effective access to state justice for Deaf individuals. Based on the dimensions of communicational, attitudinal, and technological accessibility described in the LBI, the categories of analysis used to address the main research question were defined. The study adopted a qualitative, descriptive, and exploratory approach, with bibliographic and documentary research as its primary data sources. To achieve the research objective, a questionnaire was applied to the Permanent Accessibility Commission (CPA) of the TJMA, and a request was sent to the Maranhão School of Magistracy (ESMAM) to collect data on the measures taken to eliminate and prevent barriers to the access of Deaf people to the state judiciary. Additionally, a documentary survey was conducted on the Court’s website and its institutional social media platforms (Instagram and YouTube channel). The results showed that, despite TJMA’s progress in implementing actions aligned with current legislation, these initiatives still do not guarantee full access to state justice for Deaf people. Some legal guarantees continue to be ineffectively implemented, reinforcing the need to promote and expand accessibility measures. It was concluded that investing in staff training, raising awareness, and professionalizing Libras interpreters is essential to ensure their qualified performance at all procedural stages. Only in this way will it be possible to guarantee Deaf individuals dignified and humane treatment that respects their culture and values their identity.

Com o advento de importantes diplomas jurídicos, como a Constituição da República Federativa do Brasil de 1988 (CRFB), a Convenção sobre os Direitos da Pessoas com Deficiência (CDPD), a Lei Brasileira de Inclusão (LBI) e a Lei n.o 10.436/2002, que oficializou a Língua Brasileira de Sinais (Libras), essas pessoas passaram a contar com especial proteção no ordenamento jurídico pátrio. Entre os mecanismos essenciais para a inclusão social das pessoas Surdas destaca-se o acesso à Justiça, sendo dever do poder público assegurá-lo em igualdade de condições com as demais pessoas, incluindo a oferta de adaptações e recursos de tecnologia assistiva sempre que necessário. Nesse contexto, a presente pesquisa teve como objetivo geral analisar a atuação do Poder Judiciário em relação às pessoas Surdas, buscando verificar as ações implementadas para garantir o efetivo acesso dessa população à Justiça estadual maranhense. A problemática que orientou a pesquisa consistiu em avaliar em que medida as políticas organizacionais adotadas pelo Tribunal de Justiça do Maranhão (TJMA), desde a edição da LBI, têm sido suficientes para promover a inclusão e assegurar o efetivo acesso das pessoas Surdas à Justiça estadual. A partir das dimensões de acessibilidade comunicacional, atitudinal e tecnológica descritas na LBI, foram definidas as categorias de análise utilizadas para responder à questão central da pesquisa. O estudo utilizou uma abordagem qualitativa, de caráter descritivo e exploratório, tendo como principais fontes de dados as pesquisas bibliográfica e documental. Para o alcance do objetivo, foi aplicado um questionário à Comissão Permanente de Acessibilidade (CPA), do TJMA, e encaminhada uma solicitação à Escola da Magistratura do Maranhão (ESMAM), visando coletar dados sobre as medidas adotadas para eliminar e prevenir barreiras ao acesso das pessoas Surdas ao Poder Judiciário estadual. Adicionalmente, foi realizado um levantamento documental no site do Tribunal e em suas redes sociais institucionais (Instagram e canal no YouTube). Os resultados demonstraram que, apesar dos elogiáveis avanços do TJMA na adoção de ações alinhadas à legislação vigente, essas iniciativas ainda não garantem um acesso pleno das pessoas Surdas à Justiça estadual. Algumas garantias legais permanecem sendo implementadas de forma ineficaz, o que reforça a necessidade de fomentar e ampliar medidas de acessibilidade. Concluiu-se, portanto, que é imprescindível investir na capacitação dos servidores, na promoção de ações de sensibilização e na profissionalização de intérpretes de Libras, para que possam atuar de maneira qualificada em todas as etapas processuais.
