Resumo: Since 2008, the diagnostic of economic and social crisis seems to dominate the political and academicals scenario. In that way, the role of the State it is put into question and, not rarely, it is disbelieved. Although it is shown daily in newspapers, the idea about the crisis is repeated without a reflection more accurate about the origin, meaning and what it would be more reasonable possible to do in a political and constitutionals way. With the goal of promoting a conceptual debate that would include the tension of our times in a right way, this dissertation have the purpose of offering the theorical reconstruction about the main diagnosis about economy, state, policy and law made by Jürgen Habermas in his career. Although developed in the last sixty years and made specifically about Europe, as the author himself point it out, his analysis seek to make an overall picture about the problems that lean to disturb the state of well-fair as the role model to guide the decisions in any country where It is implemented . In that way the lineation of a crisis about legitimation, in a state in which the inglorious quest it is reconcile capitalism and democracy, to not relate only to Germany or France: it goes the other way, they assume the structural tendency inherent to the well-fair State as it is designed over the 20th century. Next to it, they seek to explain the terms in with were built the theorical theses of the author that made respect about alternatives and potential data in history for the superation radically democratically of the social state in a democratically State of the law . In the end, it investigate how the economic globalization and the mutual dependent between the nation States affects the relationship between democracy and capitalism and, consequently, the right of self-determination.

Nesse contexto, o papel do Estado é questionado e, não raro, desacreditado. Apesar de figurar em jornais diariamente, a ideia da crise é repetida sem uma reflexão mais detida sobre sua origem, seu significado e sobre o que seria racionalmente possível de se realizar por meio do direito e da política. Com o intuito de promover um debate conceitual que possa apreender de maneira mais adequada as tensões do tempo presente, esta dissertação pretende oferecer reconstruções teóricas dos principais diagnósticos sobre economia, Estado, política e direito realizados por Jürgen Habermas o longo de sua carreira. Embora desenvolvidas nos últimos sessenta anos e em relação especificamente à Europa, conforme salienta o próprio autor, suas análises buscam traçar um quadro geral de problemas que tendem a assolar o Estado de bem-estar social como modelo de Estado, em qualquer país onde se implemente. Assim, os delineamentos de uma crise de legitimação em um Estado cuja tarefa inglória é conciliar capitalismo e democracia não dizem respeito somente à Alemanha ou à França: diferentemente, assumem o estatuto de uma tendência estrutural ínsita ao modelo de bem-estar social como concebido ao longo do século XX. Na sequência, busca-se explicitar os termos em que foram construídas as teorizações do autor que dizem respeito a alternativas e potenciais históricos para a superação radicalmente democrática do Estado social no sentido de um Estado democrático de direito.
