This dissertation is part of the Research Line “Fundamental Rights, Democracy and Sustainable Development”. The object of study is the national policy on work in prison and its implications in local policies, specifically in the state of Mato Grosso do Sul (MS), from the point of view of work as an instrument of reinsertion and as a content of restorative practices. Both as an instrument and a content, work is viewed as the premise of responsible resocialization, that is, the one which allows both prisoners and former prisoners to achieve decent subsistence, during and after the execution of sentence, thus preventing them from recidivism. The general objective is to analyze the national policy on work in prison, regarding the reintegration of prisoners and former prisoners in the labor and/or employment markets, as part of the realization of essential rights inherent to all human beings. The specific objectives are: to investigate the forms, contents and results of the national policy on work in prison; to analyze work and its relationship with human dignity, taken as an instrument in the formation of the individual’s identity and the foundation of their citizenship, as part of the restorative practice in the social reintegration of prisoners and former prisoners; to identify and analyze restorative practices for prisoners’ social reintegration in Mato Grosso do Sul. The methodological procedures include documentary research, literature review, existing legal studies and jurisprudence concerning the discussions proposed. The analyses consider the concepts of justice, work, reinsertion and restorative practices, guided by the theoretical framework of neocontractualism. In conclusion, the implementation of resocialization through work in MS, with the application of the restorative practices analyzed, symbolizes the opportunity for transformation of those people involved and the rise of citizenship. Such practices should be operated by the choice to work, not in which to work, far from the core elements of the working relationship, and guided by employment interests, thus making prison work a resocialization utopia.
