Resumo: | The discourse of the Law 11.705/08, commonly known as Dry Law, assured the habit of drinking and driving of brazilians been turned object of discusses on various socials segments. At the moment of its implantation, was heard a lot of small talks that marked not only the ideologic formation of the State, but also the ideologic formation and discourse formation of the officers, the driver and the passer-by. With this, there was the circling of a considerable number of discouses involving this issue, therefore,it started a war between the discuss and the liberty and the rights and dues, materialized in discouses started by people that constitutes itself on and by the discouses.We are aiming in this research analyse the discouses about the referred Law in the moment of its implantation to describe the development of this discuss and verify the effects of sides in relation to the established acts, considering that involved people in a direct and indirect way with the transit. To acquire the aimed objective, we realized a field research with questionaires aplication, instruments that permits the aproach when " talking about daily lives", where there is such flawless directions. We know that in people's discourses appears so clearly, when initiang ideologic marks that are important in the effects' constitution of discourses' sense. In the development of this research, it was checked that only the Law's implantment isn't sufficient to afford satisfactory results concerning to a secure transit, whereas,the sense of the discourse of this Law doesn't avoid that individuals give it a meaning according to its discourse formations and ideologic formation. And, when being given another meaning, we observed that the discouse of the law moves itself from the institutional sense, the one which treat everybody in an equal way, to an individual sense, the one which molds itself in consonant with its users.This research is organized in order to present how the transit Law and the drimking are meaned according to the ideologic formation occuring on a production date. Also, we talked about the ideology, subject and discourse, therefore,these concepts are established to understand the linguistic and historical materiality that surrounds the constituition of the meaning chain where the subject means itself and means the world in which is being written. We made an analysis of the drunkenness sense in discuss of principal transit law. This study began with the Law decret n. 8.324 that can be meant wuth the first way of the transit organization by the Law manner. After, we analysed the discusses of some articles of the first Brazilian Transit Code(1940), the second(1966) and also the current one(1977) already with changes established by the Dry Law(2008) that enounces the drinking of alcoolics drinks by drivers. And, in sequence, we made an analysis of how the police officer and the driver discussed the Law, however, these subjects, thus the position they are to have their discourses about the transit received, they need to remeans it.When it is done, it can be observed how the diverse discourses formations chains itselves in the constitution of Law meaning. Therefore, we observed the fails, breeds, interdiscourse, deslocations or the estabilities of meaning in driver and officer's speech about the Dry LawO discurso da Lei 11.705/08, denominada popularmente por Lei Seca, contribuiu para que o hábito de beber e dirigir dos brasileiros se tornasse objeto de discursivização nos diversos segmentos sociais. No momento de sua implantação, emergiram muitos boatos que marcam não apenas a formação ideológica do Estado, mas também a formação ideológica e discursiva do sujeito policial, do sujeito motorista profissional e do sujeito motorista que não atua profissionalmente neste ramo. Com isso, houve a circulação de um número considerável de discursos envolvendo essa temática, pois se iniciou uma batalha entre o discurso da liberdade e o discurso dos direitos e deveres, materializados nos discursos enunciados por sujeitos que se constituem no discurso e pelo discurso. Visamos, nesta pesquisa, analisar os discursos sobre a Lei Seca no momento de sua implantação para descrever o funcionamento desse discurso e verificar os efeitos de sentido em relação às práticas já “estabilizadas”, considerando os sujeitos envolvidos de forma direta ou indireta com o trânsito. Para alcançar o objetivo proposto, realizamos uma pesquisa de campo com a aplicação de questionários, instrumentos que nos permitem uma aproximação ao falar do cotidiano, em que há uma certa fluidez de sentidos (POSSENTI, 2001). Sabemos que transparecem, nos discursos dos sujeitos, ao enunciarem, marcas ideológicas que são determinantes na constituição dos efeitos de sentido do discurso. Na realização desta pesquisa, verificamos que somente a implantação da Lei não foi suficiente para alcançar resultados satisfatórios no que diz respeito a um trânsito seguro, pois o efeito de verdade inquestionável no discurso da lei não impede que os sujeitos a re-signifiquem de acordo com sua(s) formação(s) discursiva(s) e ideológica(s). E, ao ser re-significado, observamos que o discurso da lei desloca-se do sentido institucionalizado, aquele que trata todos de maneira igualitária, para um sentido individualizado, aquele que se molda conforme seus interlocutores. Esta pesquisa organiza-se em cinco capítulos. No primeiro capítulo, discutimos como a Lei de trânsito e a bebida são significadas de acordo com a formação ideológica vigente numa dada condição de produção. No segundo capítulo, falamos de ideologia, sujeito e discurso, pois esses conceitos são fundamentais para compreendermos a materialidade linguística e a materialidade histórica que norteiam a constituição das redes de sentidos onde o sujeito se significa e significa o mundo em que está inscrito. No terceiro, fazemos uma análise do sentido de embriaguez no discurso da principal lei de trânsito. Este estudo iniciou-se com o Decreto-Lei nº 8.324 que pode ser significado como o primeiro modo de organização do trânsito na forma da Lei. Depois, no quarto capítulo, analisamos os discursos de alguns artigos do primeiro Código de Trânsito Brasileiro (1940), do segundo (1966) e do atual (1997), já com as modificações determinadas pela Lei Seca (2008), que enunciavam o consumo de bebida alcoólica por motoristas. No quinto capítulo, fizemos uma análise de como o sujeito policial e o sujeito motorista discursivizam a Lei, pois esses sujeitos, pela posição que ocupam para terem seu discurso sobre o trânsito legitimado, precisam re-significá-la. E, ao re-significá-la, observa-se como as diferentes formações discursivas se interligam na constituição de sentido da Lei.
