Defesa : Curitiba, 26/03/2018Inclui referências: p.132-141Área de concentração: Direitos Humanos e DemocraciaResumo: Esse trabalho se dedica ao estudo dos comuns para, a partir disso, propor algumas reflexões sobre a democracia constitucional. Para tanto, em um primeiro momento, parte da análise de exemplos locais que manifestam características dos comuns e de como esses casos refletem, por um lado, o avanço do urbanismo neoliberal sobre a cidade e, de outro, as possibilidades de resistências que se abrem a partir disso. Na sequência, o percurso teórico sobre os comuns e alguns dos principais debates e características relacionadas ao conceito, inclusive em sua relação com o urbano, são enfrentados a fim de delimitar o que aqui se entende por comum ou comuns. Mais do que um conceito que tem se destacado na gramática dos movimentos de contestação à ordem vigente, os comuns são resultado real de um processo de instituição continuada de regras, de um constante pôr-em-comum que estabelece uma relação de uso e não de pertencimento e, dessa maneira, contraria o imperativo da propriedade absoluta. Eles engendram relações de compartilhamento e solidariedade que não se submetem nem a uma conversão à forma mercantil nem à submissão ao controle público e que se manifestam de forma particular no espaço urbano, como espaço do encontro e da diferença, articulados à luta pelo direito à cidade. Estabelecidas essas definições, é a relação entre os comuns e as noções de democracia, poder constituinte e Constituição que se buscará investigar. Nesse sentido, acredita-se que a democracia realizada nos comuns pode ser compreendida nos termos de uma democracia radical, não só na medida em que a práxis do comum consiste na tomada de decisões coletivas acerca das regras que instituem o comum, sem ignorar os múltiplos conflitos de interesses potencialmente envolvidos e abrindo-se à possibilidade de rever essas regras a qualquer momento, mas também porque os sujeitos que se articulam por essa prática jamais podem ser reduzidos a qualquer forma homogênea e universalizante. Além disso, nos termos do que se requer para proteger a experiência dos comuns, não há caminho senão pensar em uma Constituição viva, que, à maneira de uma práxis instituinte do comum regida por uma profunda democracia, não afaste o conflito e a possibilidade sempre presente da mudança, mantendo poderes constituídos e potência constituinte em constante diálogo. Trata-se de ver a Constituição como um processo, sempre aberto à interferência desses sujeitos múltiplos e irredutíveis a uma unidade. Dessa maneira, ocomum apresenta-se como uma possível ponte entre constitucionalismo edemocracia, reconciliados pela perspectiva de assumir a imanência da pluralidade e do conflito. Palavras-Chave: Comuns Urbanos. Democracia radical. Constituição radical.Abstract: This work is dedicated to the study of the commons, to propose some reflections on constitutional democracy. In order to do so, it starts from the analysis of local examples that show the characteristics of the commons and how the cases reflect, on the one hand, the advance of neoliberal urbanism in the city and, on the other, the possibilities of resistance that open from this. In the sequence, the theoretical course about the commons and some of the main debates and characteristics related to the concept, including its relation with the urban, are confronted in order to delimit what is understood here by commons or common. More than a concept that has stood out in the grammar of the movements of contestation to the prevailing order, the commons are real result of a process of continuous creation of rules, of a constant commoning that establishes a relation of use and not of belonging and, in this way, contrary to the imperative of absolute ownership. They engender shared and solidary relations that do not undergo either a mercantile conversion or submission to public control and that manifest themselves in a particular way in urban space as a space of encounter and difference, articulated to the struggle for the right to the city. Established these, is the relationship between the common and notions of democracy, constituent power and Constitution that we will seek to investigate. In this sense, it is believed that the democracy carried out in the commons can be understood in terms of a radical democracy, not only to the extent that the praxis of the common consists in making collective decisions on the rules that institute the common, without ignoring the multiple conflicts of interest potentially involved and opening up the possibility of revising the rules at any time, but also because the individuals that are articulated by this practice can never be reduced to any homogenous and universalizing form. Moreover, in terms of what is required to protect the experience of the commons, there is no way but to think of a living constitution, which, the same way that an instituent praxis of the common governed by a profound democracy, do not dispel the conflict and the possibility always present of change, keeping constituted powers and constituent power in constant dialogue. It is about seeing the Constitution as a process, always open to the interference of these multiple subjects, irreducible to a unity. In this way, the common appears as a possible bridge between constitutionalism and democracy, reconciled by the perspective of assuming the immanence of plurality and conflict.
