The research analyze the knowledge and practice of operators of laws and psychiatry in relation of Custody and Treatment Psychiatric Unit (UPCT in Brazilian Portuguese), the only institution directed to the compliance of security measures of compulsory internment in Rio Grande do Norte, from the principles that guide the process of psychiatric Brazilian reform. It problematizes the juxtaposition of the phenomena of madness and criminality and the historical claim for public policies that base itself in the enclosure of lives in the name of a public safety ideal. From the analysis of centrality of custody's measures began to occupy in penal law and in psychiatry and ruled on Insitutional Analysis postulates, propose a discussion about the present challenges of the institution in front of the new sketch of Mental Health National Policies, introduced by the process of critic elaboration and the practice of psychiatric reform. Methodologically, the research adopted a qualitative perspective, it uses an observation strategy of the institution reality, from this one was collected updated data about the functioning conditions of the UPCT. Subsequently, it proceeded the analysis of related process files of the institutional residents, through that, it was verified the arguments that base the application of compulsory internment measures. At last, semi structured interviews were performed, with the criminal judges from the capital and with the psychiatrist responsible for the institution, where the interface of the field of mental health was uncovered by justice. From the analyzers emerged from the data reading build on the field, strong lines that act in this device was noticed, that remain resistant to the process of reorientation in the field of psychosocial attention. The results illustrate how the knowledge and practice articulate and pass through the asylum space, shaping it like a stiffened molar set and practically non different of the regular prison structures, faced with the total failure of the therapeutics projects directed to the insane transgressor.
