Resumo: Much of the demand for lawsuits related to the right to health, against public authorities, is concentrated in the lawsuits of citizens claiming the supply of medicines. The judicialization of access to medicines has been a challenge for the management of pharmaceutical assistance within the scope of the Unified Health System (SUS) due to the weaknesses of social and economic policies in Brazil. We sought to describe the cities studied as to the deferred lawsuits for medicines in a region, characterize these lawsuits about number and origin and classify the medicines legalized by the cities in terms of their therapeutic classification and the components of Pharmaceutical Assistance (PA). This study aims actions at the local and regional level that result in the improvement of medication management and in the reduction of lawsuits against the State, in view of the financial, clinical and safety importance in the use of medication, that the judicialization represents. An ecological observational study was carried out, analyzing 7,492 lawsuits. The units of analysis were the cities that make up the Coordination, having as factor of study the deferred lawsuits of medicines sent by users and, as main outcome, the judicialized medicines grouped in the components of Pharmaceutical Assistance (PA). It was found that 73,6% (n = 5441) of legalized drugs are “off the list”, but there was an increase in the judicialization of drugs belonging to all components of PA in the period between 2014 and 2018. The classes of drugs most found in the lawsuits those used for the nervous system 26% (N = 283), cardiovascular 18% (N = 200) and for the digestive tract and metabolism 16% (N = 177). The data showed a high amount of drugs supplied through the judicial system, as well as making it possible to return to the studied cities of which drugs are being sought from the judiciary. This work is expected to contribute to the planning of more effective actions in order to reduce judicialization at the municipal and regional level.

This work is expected to contribute to the planning of more effective actions in order to reduce judicialization at the municipal and regional level.Grande parte da demanda de ações judiciais relacionadas ao direito à saúde, contra os poderes públicos, concentra-se nos processos judiciais de cidadãos reivindicando o fornecimento de medicamentos. A judicialização do acesso a medicamentos têm sido um desafio para a gestão da assistência farmacêutica no âmbito do Sistema Único de Saúde (SUS) devido às fragilidades das políticas sociais e econômicas no Brasil. Buscou-se descrever os municípios estudados quanto aos processos judiciais deferidos de medicamentos de uma região, caracterizar estes processos quanto ao número e origem e classificar os medicamentos judicializados por estes municípios quanto a sua classificação terapêutica e aos componentes da Assistência Farmacêutica (AF). Esse estudo tem o objetivo de propor ações em nível local e regional que resultem no aprimoramento da gestão de medicamentos e na diminuição de processos contra o Estado, tendo em vista a importância financeira, clínica e em termos de segurança no uso dos medicamentos, que a judicialização representa. Foi realizado um estudo observacional ecológico, analisando 7.492 processos judiciais. As unidades de análise foram os municípios que compõem a Coordenadoria, tendo como fator de estudo os processos judiciais deferidos de medicamentos encaminhados por usuários e, como principal desfecho, os medicamentos judicializados agrupados nos componentes da Assistência Farmacêutica (AF).Obteve-se que 73,6% (n=5441) dos medicamentos judicializados são “fora de lista”, mas observou-se um aumento na judicialização de medicamentos pertencentes a todos os componentes da AF no período entre 2014 e 2018. As classes de medicamentos mais encontradas nos processos foram aqueles utilizados para o sistema nervoso 26% (N=283), cardiovasculares 18% (N=200) e para o trato digestivo e metabolismo 16% (N=177). Os dados demonstraram uma quantidade elevada de medicamentos fornecidos pela via judicial, bem como viabilizaram um retorno aos municípios estudados de quais medicamentos estão sendo buscados junto ao judiciário. Espera-se com este trabalho contribuir para o planejamento de ações mais eficazes com intuito de reduzir a judicialização no âmbito municipal e regional.porUniversidade Federal de Santa MariaCentro de Ciências da SaúdePrograma de Pós-Graduação em Ciências da SaúdeUFSMBrasilCiências da SaúdeAttribution-NonCommercial-NoDerivatives 4.0 Internationalhttp://creativecommons.org/licenses/by-nc-nd/4.0/info:eu-repo/semantics/openAccessJudicialização da saúdeAssistência farmacêuticaSistema Único de SaúdeUso de medicamentosAcesso a medicamentos essenciaisTecnologias de saúdeHealth’s judicializationPharmaceutical servicesUnified health systemDrug utilizationAcess to essential medicinesHealth technologiesCNPQ::CIENCIAS DA SAUDEA judicialização do acesso a medicamentos no âmbito de uma Coordenadoria Regional de Saúde do Rio Grande do SulThe judicialization of acess to medicines at Regional Health Coordination in Rio Grande do Sulinfo:eu-repo/semantics/publishedVersioninfo:eu-repo/semantics/masterThesisFlores, Liziane Maahshttp://lattes.cnpq.br/7244754996330153Werlang, Maria CristinaLencina, Claiton LeonetiDall’Agnol, Marinel Morhttp://lattes.cnpq.br/9984259111475924Loreto, Daiane Rodrigues de4000000000016006006006009cd5b443-822e-47fa-8a47-1364893df3ae153623cc-ae85-43d9-9b50-e1e07628e3d5bc0b3681-8784-4e0c-85f3-7fe9234527d688a88b05-46fb-4129-90cd-e44ce837d471341083da-f86e-4fdb-9cba-bb4a843cb337reponame:Manancial - Repositório Digital da UFSMinstname:Universidade Federal de Santa Maria (UFSM)instacron:UFSMORIGINALDIS_PPGCS_2020_LORETO_DAIANE.pdfDIS_PPGCS_2020_LORETO_DAIANE.pdfDissertação de Mestradoapplication/pdf2453804http://repositorio.ufsm.br/bitstream/1/22134/1/DIS_PPGCS_2020_LORETO_DAIANE.pdf6cc0dcc8e2a0167f147426c858d02784MD51CC-LICENSElicense_rdflicense_rdfapplication/rdf+xml;
