The study focuses on analyzing whether the existing legislation on benzene is sufficient for the natural environment and the health of workers, considering the risk of contamination to workers at gas stations (PRC). The Brazilian social rights had progressed within the birth of occupational health and industrial safety rules, with a view to adapting the improvement of labor relations to new production processes, such as fundamental constitutional rights established in the Federal Constitution of the Republic of 1988 and civil liability objective based on Risk Theory. This is a basic bibliographic and documentary research with a qualitative approach, which includes the analysis and interpretation of data, information, and documents on the subject. The method is guided by a descriptive study. Systematic analyzes are made, considering the list of actions raised on the topic and the elaboration of the body of argument. The general objective of the research is to demonstrate whether the existing legislation on benzene is sufficient to protect the natural environment and the health of workers at fuel stations and services in the Presidente Prudente/SP Region and concerning to social policies and legislation measures to minimize or neutralize the risks on benzene’s exposition. Fuel station workers and services are included in one of the occupational categories most exposed to benzene, under the terms of ILO Convention n.136 and Recommendation n.144, on the risks of intoxication due to benzene, a highly carcinogenic substance.
