The dissertation has the structural litigation as its scope and the problem to address is the need of a feasibility assessment referred to collaboration with a proper judicial intervention in public policies. The hypothesis of this study is the greater feasibility of structural litigation to such purpose when complex and polycentric disputes that require prospective reasoning for its resolution are discussed. Therefore, the study brings discussions referred to criteria for adequate judicial control over public policies when this requires restructuring of a socially relevant institution or government programs for progressive and effective modification of the factual reality aiming the realization of fundamental rights and guarantees. The research is grounded on bibliographic review and analysis of related cases judged in Brazil and abroad. Taking the hypothesis as proven correct, it is concluded that structural litigation enable qualitative improvements in the judicial intervention in public policies when it adopts as conditions a broad social participation, openness to institutional dialogues and primacy of planned solutions, which are preferably derived from consensus, leading the Government to develop a restructuring plan the embeds both measurable and realistic purposes and to be implemented in accordance with a schedule, which is developed under monitoring in compliance with the experimentalist proposal.
