Resumo: | This work intends to think the structure of higher education in Brazil, a country that suffers the follies of underdevelopment. It is a more delicate task than the educational perception in countries where industrial development led to the construction of others paradigms – the ones that are target of capitalist illusions on the periphery of the system. It starts with the premise that all educational manifestation dispenses neutrality, being the result of choices in the field of politics and economics. The search turns to the legal aspect of Brazilian university construction proposing criticism of the its structure in order to understand its alliance with universal structure of the capital promotion, the productivism of the academic environment and businessfication of science and scientific production. Anísio Teixeira bridges the gap between the pedagogical thinking for the development of the country in face of the legal structure of higher education to bring to the second decade of this century a glimpse upon the threat to the instruction expansion in light of the struggle for university, specifically related to the autonomy of the university research. |

Trata-se de tarefa mais delicada do que a percepção educacional em países cujo desenvolvimento industrial conduziu a construção de paradigmas para os demais - alvo das ilusões capitalistas na periferia do sistema. Parte-se da premissa de que toda manifestação educacional prescinde de neutralidade, sendo resultado de escolhas no campo da política e da economia. A pesquisa volta-se ao aspecto jurídico da construção universitária brasileira propondo críticas à sua estrutura de modo a entender a aliança com a estrutura universal de dinamização do capital, de tecnicização do ambiente universitário e de mercadologização da ciência e da produção científica.
