The thesis reflects critically on the City Statute - a law enacted in 2001 that regulates the chapter of the federal constitution regarding the Urban Renewal - and its social implications, especially in cities with a high percentage of population living in submoradias (slums, tenements and autoconstruções) . In this framework, it identifies a greater density of democratic experiences of popular participation in urban management (such as the Participatory Budget) that brought a new emphasis on its new actors and new forms of action.In this direction, it analyzed the new scenario also implemented from 2003 with the creation of the Ministry of Cities that enforces a policy of participating in municipal management via the creation of the Master Plan Participatory estavlecido binding instrument by the Statute of the City. It was identified however that despite the new regulatory urban and diagnosis of a drastic situation of most of the poor in Brazilian cities, the public policy agenda and exclusionary municipal still closed to the wider debate and politicized to an effective implementation social rights for the excluded population.This thesis aims to contribute to this debate, bringing new issues and new insights about social movements, citizenship and the right facing the city and also the discussion about the effectiveness of the Federal Constitution in the field of social rights. It discusses public policy related to the role of the state, including those related to actions and interventions of the judiciary and social movements. Was adopted a qualitative methodology by a questionnaire for the interviews applied to 11 people linked to a significant political action, legislative, scientific research, technical and / or legal status in relation to urban violence in Rio de Janeiro, encompassing social movement activists, the judiciary, and local legislative investigators. The objectives of this thesis have been achieved by showing the possibilities of expanding citizenship via the democratic management of cities, with reference to the new legal framework bringing this debate to the field of public policy concerning practiced by the executive branch and also consider the existence of spaces of struggle for the implementation of social rights within the judiciary.
