Resumo: This is a guardianship condemnatory-preventive, a modality of process performance based on the threat of a Rights rupture, before the incident of an illicit act. The main proposal of this study is searching for characteristics of the subject comparing to the other modalities of legal guardianship. Besides, this subject is analyzed under the focus of the sentences: declaratory, constituents, condemnatory and executives. Directed by effectiveness (results-driven civil process) there is space to identify contours adapted for the application of prevention using the coercive and substitutive mechanisms. Finally, the study broaches the need to work effectively in the process without discarding the security that permeates the juridical relationships.

O propósito do estudo é buscar características do instituto frente às demais modalidades de atuação da tutela jurisdicional. Analisa-se, também o instituto à luz da classificação das sentenças – declaratórias, constitutivas, condenatórias, mandamentais e executivas-.
