This dissertation aimed to explore academic research on the concept of public order contained in article 144, § 5, of the Constitution. We defend public order in its meta-legal aspect, this interpretation being predominant in the promotion of Multidor Law and Restorative Practices proposed by the Brazilian Judiciary. In this comparison, we rely on a hermeneutic approach that the constitutional public order related to public security is hybrid, metatextual and extensive. Therefore, the understanding based only on legal assumptions, of legal public order, in our view, is not the most appropriate for the current scenario, in addition to the Federal Constitution having implicit powers that are not exhaustively set out in articles of law. In the same vein, we demonstrate that exclusively legal assumptions do not contribute to a macro-system in which the community and public bodies are committed to resolving conflicts, reducing litigation and restructuring social life. Thus, we elected the Military Police of the State of São Paulo as an institution for the scientific analysis of the aforementioned, as it is already adept at meta-legality with regard to its constitutional mission of preserving public order, in addition to being the propagator of Restoration Practices and Multidor in cooperation with the São Paulo Judiciary. Finally, we emphasize that the choice of scientific investigation related to the São Paulo Military Police was due to the fact that this author is a Police Officer of this Institution having access to data, graphs and analyzes that fostered this dissertation.
