This is a master's thesis that aims to investigate whether current legislation meets the interests of the adopted person in knowing their origin, which is enshrined as a right in art. 48 of the Child and Adolescent Statute. To reach the object and its discussion, historical-dialectical materialism and the deductive method were used. The historical materialist and dialectical method was used in the analysis of material and in the development of the text, seeking to reveal the tension, contradiction and totality between the law and reality. The deductive method is seen in the specific theme of the adopted person's right to know their origin in the face of the great theme that involves adoption, particularized within a historical scenario of family formation within the context of Brazil. It was a historical and comparative methodological procedure, especially regarding foreign legislation. The data researched demonstrates that the research is qualitative, although it also used a quantitative bias. Documentary research was carried out and secondary data extracted from literature and public research was used. It is a work divided into three chapters with a multidisciplinary bias that covers the branches of knowledge of Law, Social Service, Psychology and Economics. The methodology used allowed us to reflect on the absence of public policy post-adoption, specifically, the contradiction of the existence of the right, but the absence of instruments capable of satisfying this right, which ends up objectifying the person of the adopted person. The court ruling on adoption should not end the social process of adoption. This is a problem that arises post-adoption, but it was necessary to carry out a systematic analysis pre-adoption to find answers about adoption in bourgeois society. In this sense, adoption requires reframing to understand the complexity and peculiarity of family formation arising from adoption with reformulation of values and social concepts.
