Resumo: The objective of this work is, with a focus on the study of the origin and organization of the Brazilian State, as a Federal Democratic State of Law, and of the National Education System, which still does not exist properly as a system, with cohesive, open and interconnected units, to analyze the challenges for its implementation, due to the federal state model adopted by Brazil and the vast Brazilian territorial dimension, aiming at a new reorganization of the System by regions that prioritize education and teaching. The advances and setbacks presented by the History of education, over time, from Brazil Empire, to the period of the Republic, require reflection and search for the best model to be adopted, correcting the dysfunctionalities and preserving what has already been built. The research is relevant because with the advent of the new National Education Plan - PNE, instituted by Law No. 13,005 / 2014, valid for 10 (ten) years, aiming to articulate the national education system, in compliance with the provisions of article 214 of the Federal Constitution, the obligation to establish, in a specific law, within 2 years, the “National Education System in collaboration, to implement the guidelines, goals and strategies of the National Education Plan, was established. However, the bills in progress are not able to resolve the issues related to the establishment of the necessary cooperation between the federation's organs in matters of education, with the centralization of power and resources remaining with the Union

However, the bills in progress are not able to resolve the issues related to the establishment of the necessary cooperation between the federation's organs in matters of education, with the centralization of power and resources remaining with the UnionO objetivo deste trabalho é, com fulcro no estudo da origem e organização do Estado brasileiro, como Estado Federal Democrático de Direito, e do Sistema Nacional de Educação, ainda inexistente propriamente como sistema, com unidades coesas, abertas e interligadas, analisar os desafios para sua implementação, em razão do modelo de Estado federal adotado pelo Brasil e da vasta dimensão territorial brasileira, pretendendo-se uma nova reorganização do Sistema por regiões que priorize a educação e o ensino. Os avanços e retrocessos apresentados pela História da educação, ao longo do tempo, desde o Brasil Império, ao período da República, exigem uma reflexão e busca do melhor modelo a ser adotado, corrigindo-se as disfuncionalidades e preservando-se o que já foi construído. A pesquisa é relevante porque com o advento do novo Plano Nacional de Educação - PNE, instituído pela Lei nº 13.005/2014, com vigência por 10 (dez) anos, tendo por objetivo articular o sistema nacional de educação, em cumprimento ao disposto no artigo 214 da Constituição Federal, ficou estabelecida a obrigatoriedade de ser instituído, em lei específica, no prazo de 2 anos, o “Sistema Nacional de Educação em regime de colaboração, para efetivação das diretrizes, metas e estratégias do Plano Nacional de Educação.
