Resumo: The purpose of this work is to find procedural means to provoke the Superior Courts to overcome precedents, since, once established, they serve as an obstacle to access to the Superior Courts, thus making it impossible to re-analyze the matter. To this end, right after the Introduction of the thesis, in the second chapter, the study is dedicated to analyzing the definition of judicial precedents in the legal system and the organization of the precedent system in the country; Furthermore, the duties of the courts are detailed. In the third chapter, the objective is to investigate the overcoming of judicial precedents from the perspective of legal certainty, defining what is meant by overcoming precedents and when they can be overcome; The existence or nonexistence of assumptions for this purpose is also addressed. In the fourth chapter, the thesis turns to procedural mechanisms to overcome precedents in Superior Courts. It addresses the problem of overcoming precedents in Brazil and whether it is possible to occur through a simple petition, complaint, rescission action, new special or extraordinary appeal, among other mechanisms

Para isso, logo após a Introdução da tese, no segundo capítulo, o estudo se dedica a analisar a definição de precedentes judiciais no ordenamento e a organização do sistema de precedentes no país; além disso, são esmiuçados os deveres dos tribunais. No terceiro capítulo, o objetivo é investigar a superação dos precedentes judiciais sob a ótica da segurança jurídica, definindo o que se entende por superação de precedentes e quando eles podem ser superados; aborda-se, ainda, a existência ou inexistência de pressupostos para essa finalidade. No quarto capítulo, a tese se volta aos mecanismos processuais para superar os precedentes nos Tribunais Superiores.
