Resumo: This work focuses on examining the foundations of the criminal statute of limitations and proposes aligning the duration experienced by those in pretrial detention with that of individuals awaiting the expiration of the limitation period while at liberty. The analysis begins with the evolution of the criminal statute of limitations in Brazil, examining legislative changes, jurisprudential discussions, and its current context, strongly influenced by the protection of human rights in penal law and the concept of imprescriptibility. Furthermore, the justificatory foundations of the criminal statute of limitations are explored and critiqued, presenting independent theories that support its existence. Time, as the guiding principle of the statute of limitations, is explored from various perspectives, allowing consideration of not only chronological time but also its existential aspect. Finally, this rationale is reconciled with the theory of functional equivalence in cases of pretrial detention, where the limitation period is considered equally for those at liberty and those deprived of it, proposing adjustments to the institution accordingly

A análise tem início com o desenvolvimento da prescrição penal no Brasil, verificando as alterações legislativas, discussões jurisprudenciais e a situação atual, extremamente influenciada pela tutela penal dos Direitos Humanos e a imprescritibilidade. Adiante, são expostos e criticados os fundamentos justificadores da prescrição penal, apresentando teorias autônomas que amparam sua existência. O tempo, fio condutor da prescrição, é exposto sobre outras perspectivas, possibilitando que se pense não apenas no tempo cronológico, mas também em seu aspecto existencial.
