Resumo: | The main purpose of this work is to analyze and understand the limitations imposed by the brazilian general personal data protection law (LGPD) on the rights of data subjects, arising from trade secrets, as well as whether the aforementioned law, in any hypothesis, would be considered an additional regulation of trade secrets, given its indirect foundation in Brazil through the protection against unfair competition. The justification for this study lies in the growing importance of personal data protection in various legal systems and the need to understand how the LGPD balances transparency and the rights of data subjects with the protection of trade secrets, which is so important for the development of business activities. In this sense, the central hypothesis is that the LGPD imposes a direct limitation on the rights of data subjects for the benefit of processing agents, due to the need to protect trade secrets. methodologically, the research was conducted in a mixed manner, including quantitative and qualitative methods, and followed four phases: advanced research (documentary, exploratory, descriptive, and explanatory), general information gathering, literature review, and analysis and consolidation of research findings. the results indicate that the limitation imposed by the LGPD in favor of trade secrets has significant implications for the rights of data subjects, such as the possible limitation on the right to facilitated access and transparency in the processing of their personal data |

A justificativa para este estudo reside na crescente importância da proteção de dados pessoais em diversos sistemas jurídicos e na necessidade de entender como a LGPD equilibra a transparência e os direitos dos titulares de dados com a proteção dos segredos de negócio, tão importante para o desenvolvimento das atividades econômicas dos empresários. Neste sentido, a hipótese central é que a LGPD impõe uma limitação direta aos direitos dos titulares de dados pessoais em benefício dos agentes de tratamento. Metodologicamente, a pesquisa foi realizada de forma mista, incluindo métodos quantitativos e qualitativos, e seguiu quatro fases: pesquisas avançadas (documentais, exploratórias, descritivas e explicativas), levantamento de informações em geral, revisão bibliográfica e análise e consolidação dos achados da pesquisa.
