This is a dissertation developed in order to cassify the conduct of stalking. In this work called obsessive persecution, at first, the phenomenon is analyzed specifically in relation to the definition, historical evolution and the elements that characterize the conduct. Subsequently, the active subjects – the stalker and the passive – the victim are focoused. It ends by bringing up the discussion about obsessive persecution in Brazilian law through case law analysis on abuse of law, the agent’s intention to cause harm and the violation of fundamental rights, and on the bills currently existing in Brazil, bringing a critical analysis on the topic, given the lack of typification and recognition of the persecution, the victims remain helpless. Thanks to this, they need to change their lifestyle as a way to guarantee their safety. As a result of the aforementioned omission, it will be up to the enforcer of the law, in this way, to seek a way to safeguard the rights harmed by the persecutors.
