Through the advancement of globalization, added to other factors caused by the post-World War II period there was helped to increase global trade, commercial relations around the world became easier. Corporate outsourcing and the ease of capital displacement have made commercial relations between countries much easier, overcoming geographical and communication obstacles. However, until recently, some other questions, such as cultural issues and idiomatic comprehension, were still capable of causing some problems when drafting contracts for the purchase and sale of products between different countries. In this sense, the issues unfold even more when it comes to the import or export of commodities, whose the price is stipulated according to external factors based on demand and global supply capacity. Therefore, the objective of this dissertation is, through bibliographic research, first of all, to draw a chronological, historical and social line about the evolution of international purchase and sale contracts, from the beginning, through the advent of the so-called Lex Mercatoria and culminating with the standardization used today by INCOTERMS and standard contracts. Therefore, the research seeks to demonstrate the use and importance of such instruments agreed with the aim of resolving geographical, social, linguistic, and customary barriers, especially when the subject is the application of these agreements in the purchase and sale of soy-type commodities.
