The compliance programs present themselves as a tool linked to corporate deviation prevention, especially when they introduce new mechanisms of criminal liability s attributions ahead to the corporate organization s economic power. While the preventive potential of these programs have encouraged their adoption in corporative scope, in the other side, it s way of acting, with no well-defined boundaries in the sphere of the limits of control over employees and the delimitation of duties delegation in the intern scope of the corporation, might create the shocking of individual s liberty spaces in the corporative environment. Against this diagnosed problem, the main goal of this research was to re-evaluate compliance funcions and their efficiency, having as secondary goals to present and to discuss the context and regulation of compliance, especialy its legislation and the relation with corporate criminal liability. To achieve the goals, the methodology consisted in the application of dialectical method, opposing the sistemathic thinking, with its rationality of hermeneutical nature, and the problematic thinking, with its rationality grounded on the topic-rhetoric, applied to discuss each one of the issues involving compliance. The method was allied with bibliographic revision, complemented by documental, normative and jurisprudencial analysis. In the end, the results pointed out that compliance s functions would be both the (1) corporate crimes prevention and the (2) worker s liberty spaces protection. In order to materialize them, it s proposed the creation of employee s protection mechanisms and the confrontation of the hypothesis application possibilities in relation to the Brazilian constitutional model. The conclusions expose the possibility of future sustentation of the corporate criminal liability and compliance in Brazil, specifically if they are alined with the results found out and reaffirmed by this work.
