Resumo: The present dissertation will approach, in a bibliographical and inductive way, the nuances of the protection of political rights, in particular, related to participation in the Brazilian electoral process in the criminal prism, seeking, in a quantitative-qualitative way, to problematize the impacts of preventive detention in the electoral process. Brazil, discussing judgments of the Federal Supreme Court and the Superior Electoral Court. To this end, elementary concepts were researched, such as the "State", "Law", "Politics" and its due process, as well as the political rights related to them, culminating in the global analysis of political rights from the perspective of Criminal Law. The research was based on the use of jurisprudence, bibliographic and documentary surveys regarding the central theme. Furthermore, there will be a focus on regional systems for the protection of human (and political) rights, notably the inter-American, European and African systems. In the end, the collected considerations will be condensed and comments will be made on the jurisprudence of the Federal Supreme Court and the Superior Electoral Court, concluding on the essential role of the necessary observance of due legalcriminal process to reinforce the political guarantees of citizens. Brazilians, including candidates for elective positions and the maintenance of the health of the Democratic Rule of Law.

Para tal, foram pesquisados conceitos elementares, como do “Estado”, do “Direito”, da “Política” e seu devido processo, bem como dos direitos políticos a eles relacionados, culminando na análise global dos direitos políticos na perspectiva do Direito Penal. A pesquisa teve como embasamento a utilização de jurisprudências, levantamentos bibliográficos e documentais a respeito da temática central. Ademais, haverá enfoque nos sistemas regionais de proteção dos direitos humanos (e políticos), notadamente, dos sistemas interamericano, europeu e o africano. Ao final, condensar-se-á as considerações colhidas e serão feitos comentários à jurisprudência do Supremo Tribunal Federal e do Tribunal Superior Eleitoral, concluindo-se pelo papel essencial da necessária observância do devido processo legal-criminal para o reforço das garantias políticas dos cidadãos brasileiros, inclusive dos candidatos a cargos eletivos e a manutenção da higidez do Estado Democrático de Direito.La presente disertación abordará, de manera bibliográfica e inductiva, los matices de la protección de los derechos políticos, en particular, relacionados con la participación en el proceso electoral brasileño en el prisma penal, buscando, de forma cuantitativa-cualitativa, problematizar la impactos de la prisión preventiva en el proceso electoral Brasil, discutiendo sentencias del Supremo Tribunal Federal y del Tribunal Superior Electoral. Para ello, se indagaron conceptos elementales como el “Estado”, “Derecho”, “Política” y su debido proceso, así como los derechos políticos relacionados con ellos, culminando en el análisis global de los derechos políticos desde la perspectiva de Derecho Penal. La investigación se basó en el uso de la jurisprudencia, levantamientos bibliográficos y documentales respecto al tema central. Además, habrá un enfoque en los sistemas regionales para la protección de los derechos humanos (y políticos), en particular los sistemas interamericano, europeo y africano. Al final, se condensarán las consideraciones recogidas y se comentará la jurisprudencia del Supremo Tribunal Federal y del Tribunal Superior Electoral, concluyendo sobre el papel esencial de la necesaria observancia del debido proceso jurídico-penal para reforzar las garantías políticas de ciudadanos brasileños, incluidos los candidatos a cargos electivos y el mantenimiento de la salud del Estado Democrático de Derecho.La présente thsse abordera, de manisre bibliographique et inductive, les nuances de la protection des droits politiques, en particulier, liées à la participation au processus électoral brésilien dans le prisme criminel, cherchant, de manisre quantitative-qualitative, à problématiser la impacts de la détention préventive dans le processus électoral Brésilien, discutant des jugements de la Cour suprême fédérale et de la Cour supérieure électorale. À cette fin, des concepts élémentaires ont été recherchés, tels que «l'État», «la loi», «la politique» et sa procédure régulisre, ainsi que les droits politiques qui y sont liés, aboutissant à l'analyse globale des droits politiques du point de vue de Loi criminelle. La recherche s'est appuyée sur l'utilisation de la jurisprudence, d'enquêtes bibliographiques et documentaires sur le thsme central. En outre, l'accent sera mis sur les systsmes régionaux de protection des droits humains (et politiques), notamment les systsmes interaméricain, européen et africain.
