State action to protect the right to health occurs through public health services under its responsibility. In the context of the fundamental right to health, there are Sanitary Surveillance actions aimed at controlling the health risks inherent to the production of health goods and services. This study takes on the challenge of investigating the Sanitary Surveillance Policy in São Luís-MA, from the perspective of the Sanitary Surveillance representatives (regulatory sector) and representatives of the highly complex municipal health institutions (regulated sectors). It aims to evaluate the role of Health Surveillance in highly complex health services, focusing on its importance in promoting the quality of care provided, in the dimensions of patient safety and hospital infection control, as a critical component of state regulation. The research is a qualitative, exploratory approach of process evaluation type and is referenced in Donabedian to evaluate the object of Sanitary Surveillance which is the prevention and monitoring of health risks in the protection of users of health services. The Collective Subject Discourse - DSC was used as an analysis technique, which has testimonials as raw material, collected in empirical opinion polls through open questions, in the form of one or several synthesis discourses written in the first person singular, expressing the thought of a collectivity, as if it were the emitter of a single discourse. At the end of the study it was concluded that: amidst the interviewees 'speeches, the recognition of the relevance of Sanitary Surveillance for society and the professionals' satisfaction as subjects of this process predominated; that regulation in hospital care is still very incipient and that there is still a lack of knowledge about the importance of Sanitary Surveillance actions by SUS professionals and managers. It is necessary to establish links of Sanitary Surveillance in public health management in order to be recognized as an inseparable component of SUS and to deepen studies and discussions on the conduct of health policy in health institutions in order to effect regulatory action in control. health risks and minimize identified problems.
