The publication of the encyclical Fratelli Tutti by Pope Francis amid the COVID-19 pandemic signaled the need for a better understanding of the influence that possible narratives constructed in non-legal means can have on the understanding of human rights and contribute to the strengthening of such rights. Based on the premise that human rights are not limited to positive law, this research sought to verify how the discourses of Benedict XVI and Francis transmitted through their encyclicals contribute to the legitimization of human rights, making a comparison between the contents addressed, language used, functions performed, emphases and proposals. Therefore, this is a study of the narratives of the Catholic Church about human rights contemplated in the encyclicals of the last two popes and their influence on the contemporary view of such rights. The research was structured in three chapters. The first sought to present an overview of the Church's influence on the conception of human rights, as well as issues related to the content, scope and functions of the encyclicals. The second chapter presented the narratives of Benedict XVI and Francis regarding human rights transmitted through their encyclicals and some of the philosophical conceptions that are part of the genesis of the thoughts expressed in these pontifical documents. Finally, a comparison was presented between the encyclicals studied about human rights, highlighting their convergent points, such as their foundation in human dignity, and the particularities and emphases that differentiate them to identify a possible path for the Church to follow with regard to the theme. From a methodological point of view, the research used bibliographical sources and its main sources were the encyclicals of Benedict XVI, Deus Caritas Est, Spe Salvi and Caritas in Veritate and the encyclicals of Francis, Lumen Fidei, Laudato Sì and Fratelli Tutti, in addition to consulting other pontifical documents and critical bibliography on the subject.
