Resumo: This thesis has as object the juvenile offender in Sergipe period from 1891 to 1927. The choice of this temporal boundary is justified by the fact that it entered into force in 1891, the first Republican Penal Code was promulgated in 1927 and the Code of Minors Mello Matos, first normalization specially crafted data to guide referrals to issues involving minors of age in the twentieth century. This timeframe includes the context of the First Republic in Brazil (1889-1930) and this choice was also due to the role that education has come to occupy in the period, reflecting the ways of preventing and suppressing crime. The overall goal of the research was to understand the relationships established between Education and Crime. As specific objectives, intended to set the profile of the juvenile offender the time, to investigate the practice of the judiciary to refer cases of crimes committed by juveniles in Sergipe and apprehend the offender representations about the lowest in the period studied. In conducting this study used the approach of Cultural History and evidentiary method guided the analysis of the processes of the 1st Criminal Court and the 5th suite, both of Aracaju, which are the main sources of this study. We also investigated the newspaper "Mail Sergipe" and "Daily Morning period from 1911 to 1928 and documents such as: criminal, surveys, guides arrested, officers, laws, ordinances, regulations and reports of Presidents of the Province from 1877 to 1920. Analysis of this corpus documentary allowed to know the specifics of my object of study and to articulate these sources to the concepts of "civilization" (ELIAS, 1994), "culture" (BOURDIEU, 1972) and (CHARTIER, 1995), "Representation and appropriation "(CHARTIER, 1990),"crime and criminality (DURKHEIM, 2007) , utility law (THOMPSON, 1997) and discipline "(KANT, 1996), we expect this study to contribute to the history of the juvenile offender Sergipe in the period studied.

A escolha por essa delimitação temporal justifica-se pelo fato de ter entrado em vigor em 1891, o primeiro Código Penal republicano e em 1927 foi promulgado o Código de Menores Mello Matos, primeira normatização especialmente elaborada para nortear os encaminhamentos dados às questões que envolvessem menores de idade, no século XX. Esse marco temporal compreende o contexto da Primeira República no Brasil (1889 a 1930) e tal escolha deveu-se também ao papel que a educação passou a ocupar no período, repercutindo nas formas de prevenção e repressão da criminalidade. O objetivo geral da pesquisa foi compreender as relações que se estabeleceram entre Educação e Criminalidade. Como objetivos específicos, pretendi configurar o perfil do menor delinquente sergipano da época, investigar a prática do judiciário ao encaminhar os casos de delitos cometidos por menores em Sergipe e apreender as representações sobre o menor delinquente no período estudado. Na condução deste estudo utilizei a abordagem da História Cultural e o método indiciário norteou as análises dos processos da 1ª Vara Criminal e da 5ª Vara privativa, ambas de Aracaju, sendo estas as principais fontes deste estudo. Foram também investigados os jornais Correio de Sergipe e Diário da Manhã do período de 1911 a 1928 e documentos, como: processos criminais, inquéritos, guias de preso, ordenadores, leis, decretos, regulamentos e os relatórios dos Presidentes da Província de 1877 a 1920.
