Water scarcity is one of the main problems the world will have to deal with in the twentiethfirst century. The great current challenge is to attend to the increasing water demand and, parallely, preserve the resource which will be scarce. The Grant of water use can be one way of solving these matters. It is of the tools for the management of water resources due to the federal legislation, according to the 9.433/1997 law. The grant can be defined as an instrument through which public power awards a public or private being the right of using water resources, considering the quantity, the quality, the purpose of use and the period to be used. In the state of Rio Grande do Sul, the legislation of Grant was approved in 1994 according to the state law number 10.350. However, the instrument, which presents a number of deficiencies, was established in 1999 by the Department of Hydric Resources of the State Secretary of Environment. Considering this context, the present study makes a critical analysis of the process of grant of water use in the state of Rio Grande do Sul through the systematization of the current proceedings for the grant, the analysis of the legal aspects, the comparison of this process in this state and other states in Brazil, identifying its fragilities and making suggestions for its improvement.
