An Environmental Protection Area (APA) is a category of Conservation Units of Sustainable Use. Its aim is to discipline human occupation and conciliate soil use with conservation of natural resources. From the year 2000 on, there has been a large expansion in the creation of APAs in Brazil, especially in cities belonging to states that redistribute the Ecologic ICMS. APAs represent approximately 42% of all Conservation Units of Sustainable Use in the State, occupying more than 78% of the protected areas in the state. In this context, the present work aims at evaluating the situation of the APAs in Minas Gerais concerning their achievements in conservation of biodiversity and natural resources and evaluating the Quality Factor score of the state s APAs. The Quality Factor is an instrument determined by the Normative Deliberation number 86/05, released by State Council for Environmental Policy (DN/Copam) which aims at evaluating qualitatively the functioning of Conservation Units, by using parameters and procedures related to management. The state of Minas Gerais currently redistributes the Ecologic ICMS (State Law MG 13.803/2000) according to the Quality Factor score reached by each unit. The data analyzed has been provided by the State Institute of Forests (IEF), through the Protected Areas Management, from 2004 to 2008, concerning the initial registration and registration updates of such Conservation Units, besides the legal tools and parameters that regulate the creation, implementation and qualitative evaluation of their functioning. It was accomplished a case study that evaluated the process of implementation of two municipal APAs, located in Espera Feliz/MG, in agreement with the parameters and criterions of the Factor of Quality established by the State, adopting methodologies of management participatory. The study has shown that the great majority of the APAs isn t properly implemented, lacking a qualified technical body to implement and manage the created units. Such factors have made it clear that the redistribution of the Ecologic ICMS has had a direct inducing action on the creation of these units, instead of the conservation purposes. Besides, the implantation of new evaluation tools, currently in use by the state, has been stimulating the implementation and improvement of these units and has been showing more rigor in the process of creation and implementation of this category of Conservation Units, especially in the redistribution of the Ecolologic ICMS, pointing to a great headway in the history of APAs, which, if well managed, may be considered pilot areas for the application of sustainable actions, integrated with biodiversity conservation.
