Resumo: | This thesis has as its object of study the police power in the Brazilian penal system. The research intends to analyze the relationship between police power and state punitive power, that is, it seeks to understand the legal-political rationality of administrative law present in the Brazilian criminal justice system, with a limited focus on the practices and discourses of legal actors in the drug war context. Two central questions led to this investigation. First: what are the knowledge-power relations between the police power – and the categories arising from the administrative law that resolve around it – with the punitive state power in Brazil? Second: how do such relationships occur specifically in the Brazilian context of the war on drugs? The general objective of this research, therefore, is to make visible the invisible administrative rationality within the Brazilian penal system. Our central hypothesis argued that the manifestation of state authoritarianism remains more evident and latent when police power and punitive power intertwine, as effects are created that produce legal truths from invisible administrative law mechanisms in the plots of relations of the punitive power. Throughout the investigation, we found that the relationship of police power in the Brazilian criminal justice system has its architectural foundations in the categories of administrative discretion, which underlies police discretion; presumption of legitimacy and veracity of the acts of the public power, which legitimizes police testimony in drug trafficking crimes; and the principle of supremacy of the public interest over the private, which justifies violence and state arbitrariness in the name of a superior collective interest in fighting crime. These are dispositive from administrative law that convey a certain authoritarian legal-political rationality of the administrative area, influenced by the legal discourse of the doctrine of national security, to the functioning of the institutions of the Brazilian penal system. The methodology adopted in this work was based on the proposal of historical investigation from the Foucaultian genealogy. Bibliographic review and document analysis were used, based on the examination of legislation, legal discourses in lectures, interviews, articles, books and conferences, manual of the Superior War School and Brazilian police institutions, among other sources of historiographical research. |

La investigación busca comprender las relaciones entre el poder de policía y el poder punitivo estatal, es decir, la racionalidad jurídico-política del derecho administrativo presente en el sistema de justicia criminal patrio, con atención vuelta a las prácticas y a los discursos de los actores jurídicos en el contexto de la guerra contra las drogas. Dos interrogaciones centrales llevaron a esta investigación. Primera: ¿cuáles son las relaciones de saber-poder entre el poder de policía - y las categorías derivadas del derecho administrativo que giran a su alrededor - y el poder punitivo estatal en Brasil? Segunda: ¿cómo se producen específicamente estas relaciones en el contexto nacional de guerra contra las drogas? Luego, el propósito general de la investigación es hacer visible la invisible racionalidad administrativa inherente al sistema penal brasileño. Nuestra hipótesis central supone que la manifestación del autoritarismo estatal queda más evidente cuando el poder de policía y el poder punitivo se entrelazan, pues de eso se originan efectos que producen verdades jurídicas a partir de mecanismos de derecho administrativo invisibles en el tejido de relaciones del poder punitivo. A lo largo de la investigación, hemos constatado que la relación del poder de policía en el sistema de justicia penal brasileño tiene sus pilares arquitectónicos en las categorías de discrecionalidad administrativa, que fundamenta la discrecionalidad policial; de la presunción de legitimidad y de veracidad de los actos del poder público, que admite el testimonio policial en los delitos de narcotráfico; y del principio de la supremacía del interés público sobre el privado, que justifica la violencia y la arbitrariedad estatal en defensa de un interés colectivo superior en la lucha contra la criminalidad. Se tratan de instrumentos provenientes del derecho administrativo que transmiten cierta y autoritaria racionalidad jurídico-política, influido por el discurso de la doctrina de seguridad nacional, al funcionamiento de las instituciones del sistema penal brasileño. La metodología adoptada en la tesis tuvo como columna dorsal el plan de investigación historiográfica a partir de la genealogía foucaultiana. Se ha empleado la revisión y análisis documental, a partir del examen de la legislación, discursos jurídicos en charlas, conferencias, entrevistas, artículos científicos, libros, en manuales de la Escuela Superior de Guerra y de las instituciones policiales brasileñas, entre otras fuentes debidamente apuntadas.Esta tese tem por objeto de estudo o poder de polícia no sistema penal brasileiro. A pesquisa pretende analisar as relações entre o poder de polícia e o poder punitivo estatal, ou seja, busca compreender a racionalidade jurídico-política do direito administrativo presente no sistema de justiça criminal brasileiro, com enfoque delimitado nas práticas e nos discursos dos atores jurídicos no contexto de guerra às drogas. Dois questionamentos centrais conduziram a presente investigação. Primeiro: quais as relações de saber-poder entre o poder de polícia – e as categorias decorrentes do direito administrativo que giram ao seu redor – com o poder punitivo estatal no Brasil? Segundo: como tais relações ocorrem especificamente no contexto brasileiro de guerra às drogas? O objetivo geral desta pesquisa, portanto, é tornar visível a invisível racionalidade administrativa dentro do sistema penal brasileiro. Nossa hipótese central defendia que a manifestação do autoritarismo estatal resta mais evidente e latente quando o poder de polícia e o poder punitivo entrecruzam-se, pois criam-se efeitos que produzem verdades jurídicas a partir de mecanismos do direito administrativo invisíveis nas tramas das relações do poder punitivo. Ao longo da investigação, constatamos que a relação do poder de polícia no sistema de justiça criminal brasileiro possui seus alicerces arquitetônicos nas categorias da discricionariedade administrativa, que fundamenta a discricionariedade policial; da presunção de legitimidade e de veracidade dos atos do poder público, que legitima o testemunho policial nos crimes de tráfico de drogas; e do princípio da supremacia do interesse público sobre o privado, que justifica a violência e a arbitrariedade estatal em nome de um interesse coletivo superior de combater o crime. Tratam-se de dispositivos oriundos do direito administrativo que transportam uma determinada racionalidade jurídico-política autoritária do ramo administrativista, influenciada pelo discurso jurídico da doutrina de segurança nacional, ao funcionamento das instituições do sistema penal brasileiro. A metodologia adotada no presente trabalho teve como base a proposta de investigação histórica a partir da genealogia foucaultiana.
