The aim of this work is to describe the legal, conceptual and practical conditions surrounding the identification of the ratio decidendi of judicial precedents in relation to similar new cases, highlighting the role of distinction as a fundamental technique of comparative analysis between the precedent and the new case and basis justification for not applying this institute, if any. To this end, the functioning of the system of judicial precedents was presented, emphasizing its obligatory force for future demands and the fundamental premises for its application. The elements of ratio decidendi in relation to the various conceptual-applicative theories were conceptualized and discussed, and the technique of distinction as a means of preserving the stability of formal isonomy and legal certainty was demonstrated by the binding force of the preceding ones. The study was made through a bibliographic research, with theoretical framework supported by international and national jurists who stand out in the discussions on the subject. The conclusion was that there are practical means of identifying ratio decidendi and that the technique of distinction works for the operation of precedents, maintaining the characteristics of legal certainty and formal isonomy.
