Resumo: The present work aims to analyze the principle of trust in criminal law. The first chapter approaches the main legal provisions regarding the fundamentals of the principle of trust in criminal law, which are: the prize theory, the unpredictability of wrong conduction of others, the events that support the principle are in balance of interests and those that they base the principle on the self-responsibility of others. The second chapter contains the central thesis of this study, which is that the individual can, in an organized society, trust that others will act according to duty when there are no reasons to suspect otherwise, trust being a necessary element of the concept of civil freedom and, therefore, present in the concept of subjective right. The third chapter is dedicated to the treatment of the principle of trust in the theory of crime, both with regard to its position in the structure of the analytical concept of crime, and in the establishment of criteria to determine when the agent can trust and when that possibility will be decisive for the removal of imputation.

O primeiro capítulo aborda as principais correntes até hoje aventadas sobre os fundamentos do princípio da confiança no direito penal, que são: a teoria do prêmio, a imprevisibilidade da conduta errada do terceiro, as correntes que sustentam o princípio numa ponderação de interesses e aquelas que baseiam o princípio na autorresponsabilidade dos outros. O segundo capítulo contém a tese central deste estudo, de que o indivíduo pode, numa sociedade organizada, confiar que os demais agirão conforme o dever quando inexistem motivos para desconfiar do contrário, sendo a confiança um elemento necessário do conceito de liberdade civil e, portanto, contida no conceito de direito subjetivo.
