Efforts to make the exercise of State power more visible to the citizens have had significant advancements in the country after the Constitution of 1988. The constitutional text secured the fundamental right to access to information, forcing authorities to respond uncomfortable questions. However, even after the advent of the Law nº 12.527/2011, which disciplined the right in question, there remains difficulties to the full exercise of the guarantee. This work, then, is within this context, seeking to investigate what are the obstacles to the concretization of access to information, in a passive transparency perspective, and how Public Administrative can contribute to the right’s protection. The hypothesis developed is that hurdles are of interpretative nature, with the undue ampliation of dispositions that allow the denial of requests, and procedural, as the processual rite is not attuned for effectiveness. Thus, at first, the study analyzes the historical evolution of the right and its content, both in a subjective dimension, highlighting its individual and collective character, and an objective dimension, featuring democracy, republic and memory. Afterwards, problems examined by the requesters are examined and there is a look into bureaucratic practice and whether it respects constitutional law. In this examination, the work follows the path of a request, since its formulation until the end of appeals. At the end, proposals to overcome the hostile scenario to requesters are presented, using the contents of the fundamental right. The goal, therefore, is to secure full effectiveness to the constitutional guarantee and avoid frustration by interpretation or process.
