The indirect control of foreign jurisdiction in Brazil is carried out through a procedure of recognition of foreign judgments before the Superior Court of Justice. Although Brazilian judicial system does not interfere in the direct jurisdiction of the rendering court, the recognition procedure of the foreign judgment indirectly results in an assessment, from a domestic perspective, of whether the jurisdiction rendered by the Court of origin was legitimate. Such an assessment has been giving rise to an excessively generous interpretation in our legal system of what constitutes legitimate exercise of jurisdiction, as the Superior Court of Justice only verifies whether the exclusive bases of jurisdiction of the Brazilian judicial authority were not breached on a given case. This thesis intends to investigate the reasons that justify the need for an effective indirect control of foreign jurisdiction in the recognition procedure in Brazil and to determine whether it is possible to establish indirect jurisdictional bases in our legal system to that end. The uniform indirect jurisdictional bases that are expressed in the Judgments Project of the Hague Conference on Private International Law will serve as starting point. This paradigm should inspire a future change in the legal treatment of the subject in Brazil
