The relationship between the principle of Double Jeopardy and human rights is a relevant and current topic in contemporary legal contexts. The guarantee of Double Jeopardy, which prohibits double punishment for the same offense, is a fundamental protection for the defense of individual rights, especially regarding their freedom and dignity. However, often this guarantee is not respected within the prison system, where offenders may suffer indirect punishment during state custody, violating their fundamental human rights. In this context, this dissertation aims to analyze the relationship between the principle of double jeopardy and human rights in the prison system, investigating possible violations of this principle and its impacts on the guarantee of prisoners' human rights. Through a literature review and analysis of concrete cases extracted from inspection reports conducted in the prisons of the state of Mato Grosso in the years 2021 and 2022, the research seeks to identify the main forms of indirect punishment for prisoners in the prison system, such as the lack of access to basic health and education services, overcrowding of cells, and the lack of opportunities for work and re-socialization. Finally, compensatory remission is proposed as a way to compensate for the conditions experienced in prison. It is hoped that this research can contribute to the debate on the importance of guaranteeing the principle of double jeopardy in the prison system, aiming at the protection of prisoners' human rights and the promotion of a more just and humane justice system.
