O direito à desobediência: uma análise do direito de resistência na democracia

Resumo: The objective of this work is to study disobedience as a fundamental right for the protection of the Constitution, democracy, and human rights. Additionally, it aims to analyze the treatment that national law, comparative law, international law, and the Brazilian Supreme Federal Court give to the right of disobedience. To achieve this goal, the chosen path is divided into three parts: (a) the study of obedience to the law; (b) the analysis of the right to disobedience; and (c) considerations about the fundamental duty to disobey. Along this path, various paradoxes regarding the theme of resistance are identified and detailed in the conclusions. The work also delves into the foundations and dangers of obedience (the banality of evil), the inseparability, for the purposes of this thesis, of the democracy/disobedience binomial, questioning the theory of peaceful disobedience, affirming the existence of an implicit positivation of the right of resistance in the Brazilian Constitution, resistance through humor, and even the possibility of disobedience operated by artificial intelligence. Finally, the circumstances that give rise to the fundamental duty to disobey are examined

Finally, the circumstances that give rise to the fundamental duty to disobey are examinedO objetivo deste trabalho é estudar a desobediência como um direito fundamental de proteção da própria Constituição, da democracia e dos direitos humanos, bem como analisar o tratamento que o Direito nacional, o Direito comparado e Direito internacional, assim como o Supremo Tribunal Federal brasileiro, dispensam ao tema do direito à desobediência. Para tanto, o caminho escolhido divide-se em três partes, a saber: (a) o estudo da obediência ao direito; (b) a análise do direito à desobediência; e (c) considerações acerca do dever fundamental de desobedecer. Nessa trilha são encontrados diversos paradoxos acerca do tema da resistência, indicados um a um nas conclusões. O trabalho passa ainda pelos fundamentos e pelos perigos da obediência (a banalidade do mal); pela inseparabilidade, para os fins desta tese, do binômio democracia/desobediência; pelo questionamento da teoria da desobediência pacífica; pela afirmação da existência de uma positivação implícita do direito de resistência na Constituição brasileira; pela resistência por meio do humor; e, ainda, pela possibilidade da desobediência operada pela inteligência artificial.
