Resumo: This study aims to address the collation, the institute of inheritance law, focusing especially in the problematic issues related to the criteria for conferring collatable goods (assets). Nevertheless, before approaching this problem, we introduce the subject by addressing some considerations regarding the inheritance law, mainly as to its historical origin in Roman law, its concept, types of succession, inheritors and above all regarding to the legitimate portion, whose collation serves to ensure. Later the institute of the collation is introduced, presenting its concept, the people subject to the institute, its object, as well as controversial issues on this subject, and the main question of the study, which is: the indication of the criterion, which best serves the purpose of the institute. The issue is little debated and unfortunately is not well regulated by law. Thereby, we address the various legislative changes regarding the institute, as well as the systematization of the criteria presented by the doctrine, and we indicate the one that best fits the purpose of the institute

Não obstante, antes de abordar referida problemática, buscamos tecer algumas considerações a respeito do direito sucessório, em especial, quanto à sua origem histórica no direito romano, seu conceito, espécies de sucessões, herdeiros e sobretudo com relação à porção legítima, cuja colação serve a garantir. Em seguida, passamos a discorrer sobre o instituto da colação, apresentando seu conceito, as pessoas sujeitas ao instituto, o seu objeto, bem como questões controvertidas quanto a estes temas; e, sobretudo, a principal questão do estudo, a saber: a indicação do critério que melhor atende a finalidade do instituto. A questão é pouco debatida e infelizmente não é bem regulamentada pela lei.
