Resumo: The work seeks to build a theoretical model able to explain which characteristics of the institutions can be modified by constitutional amendment or even by the law and which, due to an instrumental relationship with fundamental rights, are protected by entrenched clauses, configuring institutional entrenched clauses. The theory has four stages. In the first, from the history of two paradigmatic experiences, the constitutional rigidity is examined. In the second, supported by political philosophy, the entrenched clause institute is analyzed. In the third, dogmatic and methodological issues related to individual rights entrenched clause are faced. Finally, in the fourth step, four institutional entrenched clauses (existence, independence, countermajority and institutional capacity) are presented, as well as some general rules of operation and their hypotheses of incidence.

O empreendimento teórico tem quatro etapas. Na primeira, a partir da história de duas experiências paradigmáticas, é examinada a problemática da rigidez constitucional. Na segunda, com apoio em categorias da filosofia política, é analisado o instituto das cláusulas pétreas. Na terceira, são enfrentadas questões dogmáticas e metodológicas associadas à cláusula pétrea dos direitos e garantias individuais.
